By accessing the DeepDefence Technologies platform or engaging our security services, you agree to comply with and be bound by these Terms of Service. If you are entering into this agreement on behalf of a company, you represent that you have the authority to bind such entity to these terms.
1. Authorization for Security Testing
Explicit Consent & Ownership: By initiating a scan or requesting a penetration test, you warrant that you are the legal owner of the target assets or have obtained explicit, written authorization from the owner to perform such testing. You are strictly prohibited from scanning any service, network, or application for which you do not have direct ownership or documented permission.
DeepDefence shall not be held liable for unauthorized testing performed by users on third-party assets. You agree to provide proof of authorization to DeepDefence Technologies upon request.
2. Use of Services
Intended Use: You agree to use the DeepDefence portal and its scanning infrastructure only in the manner they are designed and intended. Any attempt to manipulate the platform for purposes other than legitimate security assessment is a violation of these terms.
Acceptable Use: You may not use our infrastructure to launch malicious attacks, distribute malware, or conduct illegal surveillance.
Scan Impact: You acknowledge that security testing can occasionally cause system instability, service latency, or data corruption.
3. Engagement Scoping & Payments
To ensure high-quality delivery, all technical engagements require a formal scoping session before work commences.
50/50 Payment Model: Unless otherwise specified in the Statement of Work (SoW), all projects require a 50% upfront mobilization fee to initiate technical work. The remaining 50% is due immediately upon delivery of the final Security Report.
Late Payments: Invoices not paid within 15 days of the invoice date shall be subject to a late fee of 1.5% per month on any outstanding balance. DeepDefence Technologies reserves the right to suspend any ongoing services or withhold final deliverables until all overdue balances are cleared.
4. Data Integrity & Backups
Requirement: You must maintain a verified, current backup of all systems within the scope of testing. DeepDefence is not responsible for data restoration or losses resulting from testing activities.
5. Third-Party Services & Infrastructure Costs
Our testing may trigger automated responses in third-party environments (e.g., AWS, Azure, Google Cloud). The Client is solely responsible for any infrastructure costs, API usage fees, or auto-scaling expenses incurred during authorized testing.
6. Intellectual Property
DeepDefence retains all rights to its proprietary algorithms, testing methodologies, and software. Upon full payment, the Client is granted a non-exclusive license to use the generated Security Reports for internal remediation and compliance purposes.
7. Cancellation & Refund Policy
Single Engagements (Starter & Professional Plans)
Full Refund: Eligible if the Client cancels the engagement before technical work has commenced. Refunds are issued net of payment gateway transaction fees.
No Refund: Once the security assessment or technical work has started, no refunds will be issued due to the resource-intensive nature of the manual labor and technical infrastructure allocated.
Continuous Engagements (Subscription Model)
Cancellation: You may cancel your subscription at any time by sending an email to billing@deepdefence.co. Access will continue until the end of your current billing cycle.
No Prorated Refunds: We do not offer prorated refunds for partial months of service.
Processing: Approved refunds are credited back to the original payment method within 5–7 business days.
8. Limitation of Liability
DeepDefence’s total liability for any claim shall not exceed the total fees paid by the Client for the specific engagement in question. We are not liable for indirect, incidental, consequential and any kind of damages including loss of profits or data.
9. Technical Rules of Engagement (RoE)
By initiating any assessment, the Client grants DeepDefence explicit permission to bypass security controls and simulate real-world attacks.
Authorized Scope: Testing is limited strictly to assets you define in the dashboard.
Hold Harmless: You agree to hold DeepDefence harmless for unintended service interruptions or performance degradation or data corruption/loss.
Emergency Contact: You must provide valid contact details for system-level alerts during testing.
10. Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
